       CIVIL MISCELLANEOUS APPEAL No.365 of 2022

JUDGMENT: (Per the Hon'ble Dr.SA,J)

      This appeal, under Order XLIII Rule 1 of CPC, is filed by the

appellant/petitioner/plaintiff,    challenging    the     order    dated

28.04.2022 passed in I.A.No.289 of 2022 in O.S.No.21 of 2022

by the learned Judge, Family Court-Additional District Judge, at

Karimnagar,    wherein    the     subject   application   filed   by   the

appellant/petitioner/plaintiff under Order XXXIX Rule 1 and 2 of

CPC seeking ad interim injunction against the respondents/

respondents/defendants not to alienate the petition schedule property by way of mortgage, sale, lease or any other mode till disposal of the suit, was dismissed.

2. Heard both sides and perused the record.

3. In the course of submissions, learned counsel for the appellant brought to the notice of this Court that parties to the litigation have entered into a compromise vide Memorandum of Understanding dated 30.09.2022 and amicably settled the matter outside of the Court and therefore, the appellant does not want to 2 proceed with this appeal. The Memo filed vide USR No.89525 dated 11.10.2022 filed before this Court substantiates the submissions made by the learned counsel for the appellant.

4. In view of the above circumstances, all further proceedings in this appeal are closed.

5. Accordingly, this appeal is disposed of.

Miscellaneous petitions, if any, pending in this appeal shall stand closed. No costs.
