COMMON ORDER: (Per ARR,J)
These Miscellaneous Petitions are filed by the
petitioners/appellants with a prayer to condone the delay of 1162 days
in filing the Writ Appeals against the common order dated 24.09.2009
passed in W.P.Nos.18472, 18473 and 18426 of 2013.
The respondents filed counter affidavits contending that the
delay is not properly explained and they relied on several judgments of
the Apex Court stating that the delay cannot be condoned in a routine
manner. It is stated that several judgments were also cited before the
learned Single Judge regarding the delay on the part of the writ
petitioners in approaching the Labour Court and the learned Single,
after relying on the judgments of the Apex Court, affirmed the findings
of the Labour Court that there is enormous delay in approaching the
Court.
We have heard the learned counsel for the
petitioners/appellants and the learned counsel appearing for the 2nd
respondent and perused the record.
The reasons stated in the affidavits filed in support of the
miscellaneous petitions for condonation of delay in filing the writ
appeals are very vague and they are not sufficient to condone the
delay as the delay is not properly explained. The appellants are not at
all diligent in prosecuting their remedies even before the Labour Court.
They approached the Labour Court against the orders of their
termination and the Labour Court negatived their pleas, as they
approached the Labour Court after a period of 15 years and the same
was also affirmed by the learned Single Judge.
Therefore, we do not find any merit whatsoever in the
miscellaneous petitions and they are, accordingly, dismissed.
Consequently, the Writ Appeals stand rejected.
