Heard the learned counsel for respondent No.1 and
perused the record.
2. On 12.10.2022, as there was no representation for the appellants, the matter was directed to be listed today under the caption 'for orders'. Today also, there is no representation for the appellants. Earlier, vide order, dated 26.07.2007, the appeal was disposed of and thereafter, vide order, dated 26.02.2009, passed in CMA.MP.No.1922 of 2008, the appeal was restored to file. The appeal is of the year 2002. It appears that the appellants have no interest to pursue the appeal.
3. Under these circumstances, the appeal is dismissed for default. It is needless to state that the respondent No.1 is entitled to withdraw the entire amount deposited by the appellants, without furnishing any security.
Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
