JUDGMENT:-
This Criminal Appeal is preferred by the appellant/complainant
against the judgment dated 27.11.2019 passed in C.C.No.135 of 2018 by
the Special Magistrate-V, Hyderabad, acquitting the respondent
No.2/accused for the offences under Section 138 of the Negotiable Instrument Act, 1881.
2. I.A.No.1 of 2022 is filed along with the appeal to condone the delay of 27 days in filing the appeal.
3. When the matter was taken up for hearing, on 23.08.2022 and 07.09.2022, none appeared on behalf of the petitioner. Hence, the matter was posted to 12.10.2022. Even today also there is no representation on behalf of the petitioner.
4. As the petitioner is not evincing any interest in prosecuting the matter, this interlocutory application is dismissed. Consequently, this criminal appeal is dismissed confirming the judgment of acquittal dated 27.11.2019 passed in C.C.No.135 of 2018 by the Special Magistrate-V, Hyderabad against the respondent No.2 for the offence under Section 138 of N.I. Act.
5. As a sequel, miscellaneous petitions, pending if any, shall stand closed.
