JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
Heard Mr. G.Praveen Kumar, learned counsel for the
appellants and Mr. Govardhan Venu, learned counsel for the
respondent - writ petitioner.
2. This writ appeal is directed against the order dated 03.06.2013 passed by the learned Single Judge allowing W.P.No.6915 of 2013 filed by the respondent as the writ petitioner.
3. The writ petition was filed for quashing order dated 04.03.2013 passed by appellant No.2 whereby retail outlet of the respondent was suspended for a period of 30 days besides imposing a fine of Rs.1,00,000/-. By the order under appeal, the aforesaid order was set aside and appellant No.2 was directed to refund the sum of Rs.1,00,000/- deposited by the respondent. 2
4. On 05.02.2014, a coordinate Bench of this Court while admitting the writ appeal had stayed the operation of the aforesaid order dated 03.06.2013.
5. In the hearing today, learned counsel for the appellants submits that the writ appeal has become infructuous. At this stage, learned counsel for the respondent submits that the respondent may be given liberty to seek its remedy in the event any grievance subsists.
6. We record the statement of learned counsel for the respondent.
7. However, on the basis of the submissions made by learned counsel for the appellants, the writ appeal is dismissed as infructuous.
Miscellaneous applications pending, if any, shall stand closed. However, there shall be no order as to costs.
