2. This Tr.C.M.P.No.229 of 2022 is filed by the petitioner's wife against the respondent/husband with a request to transfer O.P.No.81 of 2022 from the Hon'ble Senior Civil Judge at Bhongir to the Hon'ble Additional Family Court Judge, City Civil Court at Hyderabad.
3. The respondent herein has filed the said O.P.81/2022 for divorce against the petitioner herein and it is pending before the Senior Civil Judge, Bhongir.
4. In the grounds averred by the petitioner, it is stated that she is unemployee, staying with her parents and depending upon them. She cannot go to Bhongir to prosecute the divorce petition. It seems wife has already filed a complaint before the Inspector of Police, W.P.S. South Zone, Hyderabad.
5. Therefore, it is very clear that the petitioner wife is staying at her parent's home at Hyderabad. The Respondent filed Divorce petition at Bhongir. The petitioner being lady may not be in a position to go to Bhongir to contest the said O.P. It involves not only physical strain but also financial issues.
6. Learned Counsel for the petitioner informed the Court that petitioner intending to file a maintenance case for claiming the maintenance. The Respondent husband, though received notice did not raise any objection.
7. In view of the above, there are grounds to transfer O.P.No.81 of 2022 from the Senior Civil Judge at Bhongir to the Additional Family Court Judge, City Civil Court at Hyderabad.
8. Hence, O.P.No.81 of 2022 is withdrawn from the Senior Civil Judge at Bhongir and transferred to the Additional Family Court Judge, City Civil Court at Hyderabad.
9. Accordingly, Tr.C.M.P.No.229 of 2022 is allowed.
10. As a sequel, pending Miscellaneous Applications, if any, shall stand closed.
