THE HON'BLE THE CHIEF JUSTICE UJJAL BHUYAN
AND
THE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY
WRIT APPEAL No.1023 of 2014
JUDGMENT: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
None has appeared for the appellant, though
Mr. K.Rama Krishna, learned counsel representing
Mr. E.Madan Mohan Rao, learned counsel for respondent
No.2/writ petitioner has appeared.
2. This writ appeal is directed against the order dated 09.12.2013 passed by the learned Single Judge allowing W.P.No.16028 of 2013 filed by respondent No.2 as the writ petitioner.
3. The writ petition was filed assailing the order dated 18.05.2013 passed by respondent No.1 with regard to sale of Eucalyptus Pulpwood by way of tender, further seeking a direction to respondent No.1 to negotiate with the three highest tenderers. By the order under appeal, learned Single Judge allowed the writ petition by setting aside the 2 order dated 18.05.2013 while directing respondent No.1 to negotiate the tender contract with the three highest tenderers and thereafter confirm the sale in favour of the tenderer offering the highest amount.
4. We find that a coordinate Bench of this Court while admitting the writ appeal on 22.07.2014, declined to grant stay.
5. That being the position, subject matter of the writ appeal has become infructuous.
6. Writ appeal is accordingly dismissed as infructuous.
Miscellaneous applications pending, if any, shall stand closed. However, there shall be no order as to costs.
