CRIMINAL APPEAL No.1067 OF 2013
ORDER:
This appeal, under Section 378(3) & (1) of the Code of Criminal Procedure (for short the 'Cr.P.C'), has been filed by the petitioner/State challenging the judgment dated 13.09.2011 in C.C.No.452 of 2009 on the file of II Metropolitan Magistrate for Railways, Secunderabad.
The learned counsel for the petitioner on 12.10.2022 reported that the respondent/accused had passed away.
Learned Assistant Public Prosecutor placed on record the written instructions of inspector RPF, Khammam along with the death certificate and submits that the respondent/accused was expired on 11.07.2015, thus the cause does not survive in the appeal.
Having regard to this position and recording the submission, the appeal is dismissed as abated.
As a sequel, miscellaneous petitions, pending if any, shall stand closed.
