JUDGMENT:

1. The present appeal has been directed against the judgment and decree dated 18.12.2006 in O.S.No.83 of 2003 on the file of the XII Additional Senior Civil Judge, City Civil Court, Hyderabad.

2. There is no representation for the appellant.

3. On the last date of hearing, when the matter was taken up for hearing, there was no representation for the appellant, and therefore, the matter was directed to be posted to today under the caption 'for dismissal'. In spite of matter being listed today under the caption 'for dismissal' and passed over to after lunch, there is no representation for the appellant. This shows that the appellant is not interested in prosecuting the case. Therefore, this appeal is liable to be dismissed for non-prosecution.

4. Accordingly, this appeal is dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
