CRIMINAL REVISION CASE No.1627 OF 2011
ORDER:
1. The petitioner was accused of committing theft of electric motor in Bibi General and Cancer Hospital, Chanchalguda on 02.10.2008 at 6.30 a.m. The petitioner was caught red handed and handed over to the police. Having investigated the case, charge sheet was filed under Sections 454 and 380 of IPC.
2. The VIII Additional Chief Metropolitan Magistrate, Hyderabad, having examined the witnesses P.Ws.1 to 5 and marking Exs.P1 to P3, found that the petitioner was guilty for the offence under Section 454 and 380 of IPC and sentenced to two years rigorous imprisonment under each count.
3. On appeal, the learned Metropolitan Sessions Judge, Hyderabad confirmed the conviction, however, reduced the sentence of imprisonment under both the counts to one year vide judgment in Criminal Appeal No.13 of 2011 dated 03.08.2011.
4. As seen from the record, the petitioner was shown as waste paper picker. There are no other criminal cases, which were registered against this petitioner. The offence is of the year 2008 and 14 years have passed. The petitioner has undergone the criminal trial and also the appeal proceedings before the appellate courts over a period of fourteen years.
5. Though there are no grounds to interfere with the conviction recorded by both the courts below, this Court is deems it appropriate to reduce the sentence of imprisonment to the period already undergone under both the counts.
6. Accordingly, this Criminal Revision Case is disposed off.
