         None has appeared for the petitioners on call though

Mr. Dominic Fernandes, learned Senior Standing Counsel, Central

Board of Indirect Taxes & Customs (CBIC) is present for the

respondents.

2. Prayer made in this writ petition is to set aside the order dated 18.01.2007 passed by respondent No.1 refusing to compound the offence of the petitioners in C.C.No.288 of 2001 in terms of Central Excise (Compounding of Offences) Rules, 2005.

3. Learned Senior Standing Counsel for the respondents fairly submits that Criminal Appeal No.191 of 2004 filed by the petitioners against the order of conviction dated 19.06.2004 passed in C.C.No.288 of 2001 was allowed and the order of conviction dated 19.06.2004 was set aside by the Metropolitan Sessions Judge, Hyderabad vide the judgment and ::2::

order dated 25.03.2015; therefore, the writ petition has become infructuous.

4. In view of above, this Writ Petition is dismissed as infructuous. No costs.

As a sequel, miscellaneous petitions, pending if any, stand dismissed.
