AND THE HON'BLE SRI JUSTICE NAGESH BHEEMAPAKA CIVIL MISCELLANEOUS APPEAL No.234 of 2012 JUDGMENT: (Per the Hon'ble Dr.SA,J) This appeal, under Order XLIII Rule 1(r) of CPC is filed by the appellant/defendant, aggrieved by the order and decree, dated 31.01.2012 passed in I.A.No.988 of 2011 in O.S.No.176 of 2011 by the III Additional Chief Judge, City Civil Court, Hyderabad.
2. Learned counsel for the appellant/defendant would submit that the subject suit was disposed of by the Court below and therefore, the cause in the appeal does not survive for adjudication.
3. Taking on record the said submission, the Civil Miscellaneous Appeal is dismissed as infructuous.
Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
