COMMON JUDGMENT:
1. Heard learned counsel for the appellants and learned
counsel for the respondents.
2. Learned counsel for the appellants seeks to not press the appeal against respondent Nos.1 to 7, 10 and 11.
3. Therefore, the Appeal against respondent Nos.1 to 7, 10 and 11 is dismissed as Not Pressed.
4. I.A.No.1 of 2022 is filed by the petitioners seeking to dispose of the present Appeal in terms of compromise as the petitioners and the respondent Nos.8 and 9 have settled their dispute by entering into compromise. Pursuant thereto, the appellants as well as respondent Nos.8 and 9 are present before this Court and their identify is verified. Both the parties confirmed the terms of compromise.
5. As per the Memorandum of compromise, the respondent Nos.8 and 9 agreed to pay an amount of Rs.25,00,000/- (Rupees twenty lakhs only) to the appellants towards full and final 2 settlement of the litigation. The appellants hereby agreed to relinquish their rights over the suit schedule property and further agreed to recognize the rights of respondent Nos.8 and 9 over the suit schedule property.
6. Recording the Memorandum of Compromise, the City Civil Court Appeal can be disposed of.
7. In the result, I.A.No.1 of 2022 is allowed; the City Civil Court Appeal is disposed of in terms of compromise confirming the judgment and decree dated 27.10.2016 passed by the Trial Court in O.S.No.2181 of 2011 on the file of the Court of learned II Senior Civil Judge, City Civil Court, Hyderabad. No costs. Miscellaneous Petitions, pending if any, shall stand closed.
