CITY CIVIL COURT APPEAL No. 171 OF 1998
JUDGMENT:
1. This appeal is directed against judgment and decree dated 16.04.1998 in O.S.No.166 of 1981, on the file of III Additional Chief Judge, City Civil Court, Hyderabad.
2. On the last date of hearing, learned counsel for appellants sought for adjournment, on the ground that the matter is settled out of Court and they wanted to file terms of settlement. Making note of the same, the matter was adjourned to today and posted under the caption 'for compromise'.
3. There is no representation for appellants as well as respondents. The alleged terms of compromise are also not filed. The appeal pertains to the year 1998. Hence, I do not find any reason for granting further adjournment and this appeal is liable to be dismissed for non-prosecution.
4. In the result, the appeal is dismissed for non-prosecution. No order as to costs. As a sequel, pending miscellaneous applications, if any, shall stand closed.
