        CIVIL MISCELLANEOUS APPEAL No.1970 OF 2003

JUDGMENT: (Per Hon'ble Dr. Justice Shameem Akther)

        This appeal, under Section 39 of the Arbitration Act, is filed

by the appellant-Union of India aggrieved by the order and decree,

dated 05.11.2001, passed in O.P.No.48 of 1997 by the learned VII

Senior Civil Judge, City Civil Court, Hyderabad, whereby, the

subject O.P. filed by the appellant, under Section 33 of the

Arbitration Act, seeking to set aside the Award, dated 28.04.1997,

passed by the respondent No.2/Arbitrator, was dismissed.

2. Heard the learned counsel for both sides and perused the record.

3. In the course of the submissions, it is brought to the notice of this Court that the amount covered by the impugned Award was paid. Therefore, the contentions raised herein have become academic. Under these circumstances, no further orders need to be passed in this appeal. All further proceedings in this appeal are closed.

4. Accordingly, the Civil Miscellaneous Appeal is disposed of.

Miscellaneous petitions, if any, pending in this appeal, shall stand closed. There shall be no order as to costs.
