            WRIT PETITION No. 41691 of 2022

ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Services-I appearing for respondent Nos.1, 2, 3 and 5 and Sri.R.Chandrasekhar Reddy, learned standing counsel appearing for respondent Nos. 4 and 6. With the consent of all the parties, the writ petition is being taken up for disposal at the admission stage itself.

The present writ petition is filed declaring the action of the 4th respondent in not relaxing the time one year to pass Degree examination to the petitioner by continuing the post of Junior Assistant which the petitioner has appointed in compassionate grounds in pursuance of the Proceedings vide Lr.No.A3/391/2015-1 dated 02.11.2015 as illegal, arbitrary and against to the Catena of Judgments of this Honble Court and an Apex Court .

Learned counsel for the petitioner submits that the short grievance of the petitioner is that respondent No.4 is not considering the petitioner's representation dated 31.10.2022 and prays this Hon'ble Court to direct the respondent No.4 to consider petitioner's representation, dated 31.10.2022 and pass appropriate orders in accordance with law, by considering the circumstances of the petitioner.

The learned Government Pleader for Services-I and Sri.R.Chandrasekhar Reddy, learned standing counsel submits that if the petitioner's representation dated 31.10.2022 is still pending consideration, the respondent No.4 may be directed to consider the said appeal and pass appropriate orders in accordance with law.

Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing respondent No.4 to dispose the petitioner's representation, dated 31.10.2022 3 and pass appropriate orders in accordance with law, by considering the circumstances of the petitioner, as expeditiously as possible, preferably within a period of six (06) weeks from the date of receipt of the order, after giving a fair opportunity of hearing to the petitioner and communicate the same to the petitioner.

6. Accordingly, this writ petition is disposed of. Miscellaneous application, if any pending, shall stand closed. No order as to costs.
