CIVIL REVISION PETITION No. 2436 of 2022
ORDER: (Per Hon'ble Sri Justice P Naveen Rao)
Heard learned counsel for petitioner Sri Y.Balaji
and learned counsel for respondents Sri S.Sridhar.
2. This revision is preferred challenging the order of the trial Court dated 1.11.2022 in Arb.O.P. No. 02 of 2022 passed by the Judge, Family Court cum IV Additional District and Sessions Judge, Sangareddy. The relevant portion reads as under:
"........... In view of the directions of the division Bench of Honourable High Court of Judicature for the state of Telangana at Hyderabad in CRP No. 2035 of 2022, the arguments in I A No. 233 of 2022 are heard and it is posted for orders to 08.11.2022. If I.A. No.232 of 2022 is allowed, the Arb OP No. 02/2022 will be reopen so as to given opportunity to petitioner in I A No. 233 of 2022, otherwise orders will be passed in Arb OP No. 02/2022. Hence, Arb OP No. 02/2022 is posted for judgment on 8.11.2022."
3. When the matter is taken up for consideration, learned counsel for petitioner produced copy of the order of the Hon'ble Supreme Court dated 7.11.2022 whereunder interim orders granted on 11.7.2022 were directed to be continued until further orders.
4. In view of the orders of the Hon'ble Supreme Court dated 7.11.2022 no further orders are required to be passed in this revision. However, learned counsel expressed apprehension that the trial Court in the order dated 1.11.2022 directed to post I.A. No. 232 of 2022 and Arb OP No. 02 of 2022 together for orders on 8.11.2022, though matter is adjourned now even after final orders are passed by the Hon'ble Supreme Court, the trial Court may proceed with the matter and may pass orders in I A No. 232 of 2022 and Arb.O.P. No. 2 of 2022, simultaneously, without giving reasonable opportunity.
5. Since the matter is seized by the Hon'ble Supreme Court, we are not inclined to express any opinion on the issue as to what orders the trial Court would pass after disposal of SLP by the Hon'ble Supreme Court.
6. The revision petition is disposed of granting liberty to the petitioner to workout remedies available under law, if any adverse orders are passed by the trial Court after disposal of SLP by the Hon'ble Supreme Court. No costs. Miscellaneous applications, if any pending stand closed.
