ORDER (ORAL):
The grievance of the petitioner in this writ petition is that police have not served upon him a copy of closure report as directed by this Court vide order dated 03.11.2022 in W.P.No.40471 of 2022, and the same is contrary to the authoritative pronouncement of the Honourable Supreme Court in Lalita Kumari vs. Government of U.P1
2. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.
3. The learned Assistant Government Pleader for Home submitted that upon receipt of the order dated 03.11.2022 passed by this Court in W.P.No.40471 of 2022, police have sent copy of closure report to the petitioner. A copy of the said report is also attached to the written instructions received by the learned Assistant Government Pleader. It is further submitted by the learned Assistant Government Pleader that delay, if any, may be condoned as it is not intentional. As per the enquiry of the police, after GD entry was made pursuant to the complaint lodged by the petitioner, it was revealed that a suit in O.S.No.231 of 2005 on the file of the II Additional Junior Civil Judge, 1 2014 (2) SCC 1 2 Karimnagar, was filed by the petitioner and others against one H. Komuraiah and others, and the same was dismissed vide judgment dated 27.02.2017. Challenging the said judgment, the petitioner and others filed A.S.Nos.47 of 2017 and 48 of 2017 before the II Additional District Judge, Karimnagar. In such background, the complaint of the petitioner was closed as "civil in nature" on 02.11.2022. Learned Assistant Government Pleader further submitted that if the petitioner again approaches the police with relevant documents, respondent No.3 will take necessary action as per law.
4. In view of the aforesaid submissions of the learned Assistant Government Pleader, no further orders are required to be passed and the writ petition is, accordingly, disposed of. If any additional documents are furnished by the petitioner, the police shall take such documents also into consideration and conduct enquiry/investigation as expeditiously as possible in accordance with law.
As a sequel thereto, miscellaneous applications, if any, pending shall stand closed.
