CONTEMPT CASE No.413 of 2020
ORDER: (Per the Hon'ble the Chief Justice Ujjal Bhuyan)
Heard Mr. Mamidi Avinash Reddy, learned counsel
for the petitioner and Mr. T.Koteswara Rao, learned
counsel for the respondent.
2. This contempt case has been filed alleging wilful and deliberate non-compliance of judgment and order dated 09.09.2019 passed in W.A.No.1384 of 2018.
3. In the hearing held on 16.09.2022, we were informed that National Insurance Company Limited has preferred SLP (C) Diary No.10141 of 2020 assailing the judgment and order dated 09.09.2019 passed in W.A.No.1384 of 2018. We were further informed that in the said proceeding 2 Supreme Court had issued notice and had granted interim stay. The matter was to be listed on 21.10.2022.
4. In the hearing today, learned counsel for the petitioner submits that on 21.10.2022 the matter did not reach and the next date of hearing is 18.11.2022.
5. At this stage, Mr. T.Koteswara Rao, learned counsel for the respondent submits that the contempt case may be closed subject to outcome of the SLP pending before the Supreme Court. He submits that if an adverse order is passed, respondent would be bound to comply with the judgment and order dated 09.09.2019.
6. We record the above statement of learned counsel for the respondent. Further, if petitioner continues to be aggrieved by the action of the respondent, it would be open to the petitioner to avail her legal remedy.
7. With the above observation, the contempt case is disposed of.

Miscellaneous applications pending, if any, shall stand closed. However, there shall be no order as to costs.
