CIVIL MISCELLANEOUS APPEAL No.738 of 2008
JUDGMENT:
None appears on behalf of appellants. Perused the proceedings dated 26.10.2022. Presence or representation on behalf of the appellants is felt essential to proceed further as the Civil Miscellaneous Appeal is pending since 2008 onwards without any progress. Therefore, having regard to the facts of the case and also in view of the fact that since 2008 this Civil Miscellaneous Appeal is pending, I do not find any merit to adjourn the matter in the absence of proper representation on behalf of appellants. Accordingly, this Civil Miscellaneous Appeal is dismissed for default for non-prosecution. Miscellaneous applications, if any pending, shall stands closed. In the circumstances of the case, there shall be no order as to the costs.
