CRIMINAL APPEAL No.959 OF 2010
JUDGMENT:
This Criminal Appeal is filed by the Appellant/Accused aggrieved by the conviction recorded by the IV Additional Metropolitan Sessions Judge, Hyderabad, in S.C.No.282 of 2009, dated 28.04.2010, convicting the accused for the offence punishable under Section 324 of the Indian Penal Code, and sentence to pay a fine of Rs.3,000/-.
2. During the course of arguments, learned counsel for the appellant/accused submits that the sole appellant in this case i.e. S.Harjeet Singh Asthania, s/o.late Darshan Singh, died and accordingly filed a Memo in proof of his death. Learned counsel submitted that in view of the death of the sole appellant, the present Criminal Appeal stands abated.
3. In the light of the aforesaid submission made by the learned counsel for the appellant and in view of the Memo filed in proof of death of the appellant, the Criminal Appeal is dismissed as abated.
Miscellaneous applications, if any, pending shall stand dismissed.
