JUDGMENT:

1. Heard.

2. Perused the record.

3. This matter has already been settled before the Lok Adalat on 13.08.2022 and therefore, this appeal is disposed of in view of the directions of the Lok Adalat, which are as follows:

AWARD Compensation Awarded Rs.2,00,000/- (Rupees Two lakhs only) together by the Tribunal with simple interest @ 7.5% per annum from the date of filing of the original petition till the date of deposit or realization and costs thereon. Compensation Awarded The matter is settled before the Lok Adalat. The (Settlement Reached) in Respondent/Petitioner/Claimant has agreed to the Lok Adalat. receive Rs.1,45,000/- (Rupees One lakh forty five thousand only) towards full and final settlement in addition to the amount that was already deposited i.e., 50% of the awarded amount deposited by the Insurance Company at the time of filing of appeal. The Appellant/Insurance Company shall deposit the above settled amount within a period of six (6) weeks from the date of receipt of copy of this award. In the event of default or delay in making such deposit, the amount payable shall carry interest at 12% per annum from the date of default.

4. Additional Direction(s) :
a) The Appellant is entitled to the refund of Court Fee paid in this appeal.
b) The amount already deposited by the Insurance Company shall be given credit to if any.
c) The Respondent/petitioner/claimant is permitted to withdraw the entire amount soon after deposit by the Insurance Company.
i. In token of consent for the above settlement and award, the parties and their counsel have signed this award in our presence.
ii. In terms of the compromise arrived at between the parties, this case stands disposed of.

5. Appeal is accordingly disposed of. Copy of proceedings of the Lok Adalat is to be annexed to this judgment as part and parcel.

6. In the circumstances of the case, the parties shall bear their respective costs.

Miscellaneous petitions, if any, pending, in this M.A.C.M.A., shall stand closed.
