WRIT PETITION No.40471 of 2022
ORDER:
Heard Sri M.Ratan Singh, learned counsel for the petitioner, and learned Assistant Government Pleader for Home.
2. This writ petition is filed seeking a direction to respondent No.4- Station House Officer, Manakondur Police Station, to issue First Information Report (F.I.R.) on information given by the petitioner on 21.10.2022 sent through Registered Post with Acknowledgment Due, acknowledged by respondent No.4 on 26.10.2022.
3. Having received the written instructions dated 03.11.2022, the Learned Assistant Government Pleader for Home, submits that GD entry was made on the petition lodged by the petitioner herein. Enquiry is being done. After enquiry, the case was referred as 'civil in nature' as the dispute pertains to land. Moreover, no evidence has been submitted by the petitioner.
4. Learned counsel for the petitioner relies on the judgment of the Honourable Supreme Court in Lalita Kumari v. Government of 2 BVR,J W.P.No.40471_2022 U.P1. As it is reported that the case has been closed as 'civil in nature', this Court is not inclined to express any opinion.
5. Accordingly, this writ petition is disposed of. The Station House Officer, Manakondur Police Station shall communicate copy of closure report to the petitioner within three days. If the petitioner is aggrieved by the closure report, he may invoke appropriate legal remedies available under law.
As a sequel thereto, the miscellaneous petitions, if any, pending shall stand closed. No order as to costs.
