CIVIL MISCELLANEOUS APPEAL No.486 OF 2006
JUDGMENT: (Per Hon'ble Dr.SA,J)
This appeal, under Section 47 of the Guardian and Wards Act,
1890, is filed by the appellant/mother aggrieved by the order and
decree, dated 26.05.2005, passed in G.W.O.P.No.3 of 2002 by the
learned I Additional District Judge, Mahabubnagar, whereby, the subject
G.W.O.P. filed by the respondent/father, under Section 25 of the
Guardian and Wards Act, seeking to grant him custody of the minor child, by name Ramasubramaniam @ Saroj, was allowed.
2. There is no representation for both sides. Perused the record.
3. As seen from the material placed on record, the subject matter of the appeal relates to custody of the minor child. The minor child, by name Ramasubramaniam @ Saroj, was aged about 5 ½ years as on the date of filing of the subject G.W.O.P. Now, he had attained majority. Under these circumstances, the cause in the appeal does not survive for adjudication.
4. Accordingly, this appeal is dismissed as infructuous.
Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
