AND THE HON'BLE SRI JUSTICE NAGESH BHEEMAPAKA CIVIL MISCELLANEOUS APPEAL No.308 OF 2017 JUDGMENT: (Per Hon'ble Dr.SAJ) This Civil Miscellaneous Appeal, under Order XLIII Rule 1 of CPC, is filed by the appellants/defendant Nos.1 and 2, aggrieved by the order, dated 05.12.2016 passed in I.A.No.438 of 2015 in O.S.No.49 of 2015 by the learned Judge, Family Court-cum-VIII Additional District Judge, Mahabubnagar.

2. Head both sides. Perused the record.

3. The appellants/defendant Nos.1 and 2 are unsuccessful in obtaining ad interim injunction in their favour. The subject suit was filed in the year, 2015 and it is ripen for disposal. At this juncture, it is not appropriate to go into the merits of the appeal and determine the same. A direction to the Court below to dispose of the subject suit expeditiously would suffice.

4. Under these circumstances, the learned Judge, Family Court- cum-VIII Additional District Judge, Mahabubnagar, is directed to dispose of the subject suit in O.S.No.49 of 2015 expeditiously, preferably, within a period of six (06) months from the date of receipt of a copy of this order.

5. With the above direction, the Civil Miscellaneous Appeal is disposed of.

Miscellaneous Petitions, if any, pending in this appeal, shall stand closed. There shall be no order as to costs.
