         CRIMINAL REVISION CASE No.1104 OF 2006

JUDGMENT:

This revision is filed by the petitioner/defacto complainant challenging the Judgment of the Assistant Sessions Judge at Siddipet in S.C.No.306 of 2004, dt.27.03.2006, wherein the learned Assistant Sessions Judge acquitted the respondents 2 to 4/Accused Nos.2 to 4 for the offence under Section 304-B of the Indian penal Code.

2. The case of the petitioner/defacto complainant is that his eldest daughter was married to Accused No.1 and a dowry of Rs.80,000/- was given in the year 1998. Thereafter, there was harassment by respondents 2 to 4 who are Accused Nos.2 to 4 and also Accused No.1-Husband of the deceased, for which reason, she committed suicide.

3. Learned Assistant Sessions Judge having examined the witnesses PW1 to PW14 and marking Exs.P1 to P10, found that no case was made out against these petitioners/A2 to A4, since 2 the allegations made against them were omnibus and there is no direct involvement, the said case was not proved.

4. The petitioner/defacto complainant has filed present application on the ground that since there are allegations leveled against respondents 2 to 4, the acquittal recorded by the learned Assistant Sessions Judge has to be reversed.

5. Under Section 401(3) of the Cr.P.C., this Court under revisional powers, cannot convert an acquittal into conviction. Further, as seen from the findings of the learned Assistant Sessions Judge, which are based on evidence of witnesses, this Court finds no grounds to remand the case back to the trial Court.

6. Accordingly, the Criminal Revision Case is dismissed.

Miscellaneous Petitions, if any, pending, shall also stand closed.
