APPEAL SUIT No.1776 of 2003
JUDGMENT:
This appeal is filed against the Judgment and decree of the trial Court in O.S.No.25 of 1994 dated 28.02.2002.
2. The suit in O.S.No.25 of 1994 is filed by the respondent herein for recovery of damages and the same was decreed in favour of the respondent by order dated 28.02.2002. Aggrieved by the same, present appeal has preferred by the Government. The appeal was admitted with condition to deposit 50% of the decreetal amount, but inspite of direction to verify the same on 20.10.2022, it was not verified by the Government Pleader for appeals.
3. As the appeal is admitted with condition to deposit half of the decreetal amount and the learned counsel for the appellant is not sure whether the amount is deposited or not, this Court finds that appeal itself is not maintainable and is liable to be dismissed. There shall be no order as to costs. 2
Miscellaneous petitions pending, if any, shall stand closed.
