JUDGMENT
When the matter is taken up for hearing, there is no representation for the appellant.
On 14.12.2022, there is no representation for the appellant. On 08.11.2022 appellant counsel stated that the appeal was already dismissed. He intend to restore the same but he could not turn up and therefore, the matter was directed to be listed today under the caption 'for dismissal'. Today also, there is no representation for the appellant. Therefore, this Court is of the considered view that the appellant is not interested to pursue the litigation.
Hence, the Appeal is dismissed for non-prosecution. No costs.
Pending miscellaneous applications, if any, shall stand closed.
