JUDGMENT:
When the matter was taken up for hearing on 08.12.2022, there was no representation for the appellants in the forenoon or in the afternoon, therefore, the matter was ordered to be listed on 22.12.2022. However, when the matter is listed today under the caption "for dismissal", it is stated by the learned counsel for the appellants that he has no instructions.
2. Considering the statement of the learned counsel for the appellants that, he has no instructions to prosecute the matter, second appeal deserves to be dismissed for default and for non-prosecution.
3. Therefore, the second appeal is dismissed for default and for non-prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
