AND THE HON'BLE SRI JUSTICE A.SANTHOSH REDDY CIVIL MISCELLANEOUS APPEAL Nos.82 AND 35 OF 2016 COMMON JUDGMENT: (Per Hon'ble Dr.SA,J) These Civil Miscellaneous Appeals, under Order XLIII Rule 1 of CPC is filed by the appellant/petitioner, aggrieved by the common order and decree, dated 19.11.2015 passed in I.A.Nos.1389 and 1390 of 2014 in O.S.No.91 of 2014 by the Judge, Family Court-cum-Additional District Judge, Khammam, respectively, whereby the subject applications filed by the appellant/petitioner under Order XXXIX Rule 1 and 2 r/w Section 151 of C.P.C., were dismissed.
2. Heard the learned counsel for both sides and perused the record.
3. In the course of submissions, it is brought to the notice of this Court that the subject suit is coming up for cross- examination of witnesses.
4. The subject suit is of the year 2014. It is pending for more than five years. As per the circular orders of the Hon'ble High Court, utmost priority has to be given to the cases, which are pending for more than five years and 2 required to be disposed of expeditiously. At this juncture, dwelling upon the merits of the case and expressing opinion is not proper.
5. Therefore, the learned Judge, Family Court-cum- Additional District Judge, Khammam, is directed to dispose of the subject suit in O.S.No.91 of 2014, in accordance with law, expeditiously, preferably, within a period of three(3) months from the date of receipt of a copy of this order.
6. With the above direction, the Civil Miscellaneous Appeals are disposed of.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
