JUDGMENT:
1. The present appeal has been directed against the judgment and decree dated 27.02.2009 in O.S.No.3368 of 1999 on the file of the XVII Additional Chief Judge -cum- III Additional Metropolitan Sessions Judge, Hyderabad.
2. There is no representation for appellant. Learned counsel for appellant filed memo dated 02.11.2022 submitting that in spite of specifically addressing letter to his client, there is no response from him and he has no instructions. The said letter was returned with an endorsement addressee died.
3. As seen from the docket proceedings, the appellant died and no steps have been taken to bring his legal representatives on record. Hence, this appeal is liable to be dismissed for non- prosecution.
4. In the result, the appeal is dismissed for non-prosecution. There shall be no order as to costs. Miscellaneous petitions, if any, pending, shall stand closed.
