I.A.No.1 of 2018 is filed by the petitioner/appellant under
Section 5 of Limitation Act, seeking to condone the delay of 40
days in filing the appeal.
2. Heard. Perused the record.
3. In the course of submissions, it is brought to the notice of
this Court by the learned counsel for the appellants that the
subject suit in O.S.No.64 of 2015 on the file of the Principal District
Judge, Karimnagar, was dismissed vide judgment dated
05.02.2020
and therefore, the cause in the appeal does not survive for adjudication.
4. Recording the said submission, I.A.No.1 of 2018 and CMA No.34 of 2018 are dismissed as infructuous. No order as to costs.
Miscellaneous petitions if any, pending, shall stand closed.
