CITY CIVIL COURT APPEAL No.116 of 2016
JUDGMENT:
1. Today, when the matter is taken up for hearing, there is no representation for the learned counsel for the appellant, in spite of grant of multiple adjournments.
2. The present suit i.e., O.S.No.1489 of 2008 is filed for eviction, recovery of arrears of rents and mesne profits. The suit is of the year 2008. But for this pendency of the proceedings, the relief granted to the respondents in the suit could not be cancelled.
3. In the said circumstances, this City Civil Court Appeal is dismissed for non prosecution. Interim orders granted, if any, stand vacated. No costs. Miscellaneous petitions pending, if any, shall stand closed.
