                WRIT PETITION No.32622 of 2022

ORDER:

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

2. The petitioner herein is claiming that he is absolute owner and possessor of land admeasuring Ac.0-12 gts in Sy.No.39/58, situated at Siddaram Village, Sathupally Mandal, Khammam District. According to him, it is assigned land as per pahanis of 1954-1955. In proof of the same, he has filed copy of pahanis. Even then, without considering the said facts, revenue authorities have mentioned the aforesaid property in the Prohibited List. According to him, the said inclusion of the subject property in the prohibited list by the revenue authorities is illegal and also contrary to the Judgment passed by this Court in W.P.No.22760 of 2008 dated 24.10.2008. Even then, the 2nd respondent is not deleting the aforesaid land from the prohibited list. Therefore, the present Writ Petition. 2

Whereas, the learned Assistant Government Pleader for Revenue, on instructions would submit that petitioner herein has to submit online application in terms of CCLA's Circular No.1/2021, dated 15-01-2021 with the 2nd respondent and on filing such an application, 2nd respondent will consider the same and pass appropriate orders.

In view of the aforesaid discussion, this Writ Petition is disposed of granting liberty to the petitioner to submit online application with the 2nd respondent in terms of aforesaid circular along with copy of pahanies and also aforesaid judgment dated 24.10.2008 in W.P.No.22760 of 2008. On receipt of the said online application, the 2nd respondent shall consider the same and pass appropriate orders by putting the petitioner and all affected parties on notice and affording them an opportunity of hearing. The 2nd respondent shall also consider the instructions issued by Chief Secretary and CCLA's Ref.No.CMRO/3691/2022 dated 03.11.2022. He shall complete the aforesaid exercise within a period of 3 eight (08) weeks from the date of receipt of online application. There shall be no order as to costs.

As a sequel, the miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
