ORDER: (Per Hon'ble Sri Justice Abhinand Kumar Shavili)
When the matter is taken up for hearing, learned
counsel for the petitioner submitted that the issue raised
in the present Writ Petition is squarely covered by a
judgment passed by this Court in W.P.No.39899 of 2022
and batch, which was allowed by this Court vide order
dated 16.11.2022.
2. In view of above, by following the orders passed by
this Court in W.P.No.39899 of 2022 and batch, which
was allowed by this Court vide order dated 16.11.2022,
the present Writ Petition also deserves to be allowed on
similar lines.
3. It is made clear that if the petitioner secure
admission in the stray counseling, the petitioner shall give
an undertaking that she will not vacate the seat and if she

vacates, then the 2nd respondent-University is entitled to
take action as per regulations including debarring the petitioner for a period of three (3) years.
4. Accordingly, the Writ Petition is allowed as above. No costs.
5. Miscellaneous petitions, if any, pending shall stand closed.
