AND THE HON'BLE SRI JUSTICE NAGESH BHEEMAPAKA CIVIL MISCELLANEOUS APPEAL No.461 OF 2018 JUDGMENT: (Per Hon'ble Dr.SA,J) This appeal, under Order XLIII Rule (1) read with Section 104 C.P.C., is filed by the appellant/plaintiff aggrieved by the order and decree, dated 07.02.2018, passed in I.A.No.387 of 2017 in O.S.No.235 of 2011 by the learned XXVI Additional Chief Judge, City Civil Court, Hyderabad.
2. Heard. Perused the record.
3. Learned counsel for the appellant/plaintiff would submit that the parties have compromised the subject matter of the Suit in O.S.No.235 of 2011 on the file of learned XXVI Additional Chief Judge, City Civil Court, Hyderabad, and therefore, cause in this appeal does not survive for adjudication.
4. The said submissions are taken on record.
5. Accordingly, the appeal is dismissed as infructuous.
Miscellaneous Petitions, if any, pending in this appeal shall stand closed. There shall be no order as to costs.
