CIVIL MISCELLANEOUS APPEAL No.224 of 2021
JUDGMENT: (Per the Hon'ble Dr.SA,J)
Heard the learned counsel for both sides and perused the
record.
2. Learned counsel for the appellant would submit that in
spite of his best efforts, he could not get instructions from the
appellant to proceed with the subject matter of the appeal.
3. Learned counsel for the respondents would submit that he
has no instructions from the respondents.
4. A perusal of the online case status of the subject O.S.No.237 of 2020 placed before this Court by the Registry reveals that the subject suit was dismissed as not pressed on 09.06.2022.
5. Under these circumstances, the cause in the appeal does not survive for adjudication. 2
6. Accordingly, the Civil Miscellaneous Appeal is dismissed as infructuous.
Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
