JUDGMENT:
Since 24.01.2022, at the request of the learned counsel for the appellant the matter is adjourned on five occasions.
2. There was a specific direction on 01.12.2022 that "no further adjournment will be granted in this matter". Again when the matter was listed on 07.12.2022, as there was no representation for the appellant either in the forenoon or in the afternoon, it was directed to be listed under the caption "for dismissal" on 08.12.2022.
3. Though the matter is coming up under the caption "for dismissal", today also there is no representation for the appellant either in the forenoon or in the afternoon. Learned Counsel for the respondents is present.
4. Therefore, the second appeal is dismissed for default and for non-prosecution.
Pending miscellaneous applications, if any, shall stand closed.
