THE HON'BLE SRI JUSTICE A.VENKATESHWARA REDDY CIVIL MISCELLANEOUS APEAL NO.1116 OF 2019 JUDGMENT:
This civil miscellaneous appeal is filed assailing the orders dated 15.10.2019 passed in I.A.No.196 of 2019 in A.S.No.15 of 2019 on the file of the learned II Additional District Judge, Nalgonda at Suryapet.

This interlocutory application in I.A.No.196 of 2019 was filed under Order 39, Rule 1 and 2 read with Section 151 of Civil Procedure Code (for short 'CPC') for temporary injunction and the learned Judge of the appellate Court has dismissed the said application. Feeling aggrieved by the same, this civil miscellaneous appeal is filed.
3. Be it stated that as per the case status information, before the first appellate Court, the lower Court record was called for and it was received by 23.09.2021 itself and ever since then the appeal suit in A.S.No.15 of 2019 is being adjourned only for arguments. Therefore, having regard to the fact that the appeal suit is ripen for disposal, in my considered opinion, at this stage, it is not desirable to pass any orders in the interlocutory application in this civil miscellaneous appeal wherein the order in I.A.No.196 of 2019 is questioned. Therefore, while recording the submissions made by the learned counsel for the appellant, considering the factual matrix of the case and status of A.S.No.15 of 2019, the learned Judge of the appellate court is hereby directed to make every endeavour for disposal of the said appeal suit within a period of three months from the date of receipt of copy of the order without seeking any further extension of time.
4. With the above direction, this civil miscellaneous appeal is disposed of. However, in the circumstances of the case, there shall be no order as to the costs. Miscellaneous applications, if any pending, shall stands closed.
