SECOND APPEAL No.1045 of 2000
JUDGMENT:
On 13.06.2022, it was reported to the Court that the appellant No.1 died and sought time to bring the LRs of the appellant No.1 on to the record. Therefore, the matter was directed to be listed on 20.06.2022.
2. Inspite of specific direction of the Court, the matter was not listed on that day and it was listed on 18.11.2022. On the said day, there was no representation for the appellants. Again when the matter was listed on 02.12.2022, as there was no representation for the appellants in the forenoon or in the afternoon, it was directed to be listed under the caption 'for dismissal' on 05.12.2022.
3. Though the matter is coming up under the caption 'for dismissal', today also there is no representation for the appellants either in the forenoon or in the afternoon.
4. Therefore, the second appeal is dismissed for default and for non-prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
