WRIT PETITION No.43613 of 2022
O R D E R:
This writ petition is filed seeking the following relief:
"...to issue a Writ Order or direction more particularly one in the nature of Mandamus declaring the action of the 2nd respondent in passing the order by restoring the original posts of the respondents 5 to 7 and also the restore the cheque power to the 6th respondent vide Rc No P1/896/2021 dated 23-07-2022 by not initiating the criminal action against the 5th respondent wherein a Writ Petition No 31219/2022 is pending before the Honble High Court without outcome of the writ petition the 2nd respondent illegally reinstate and restore the cheque power to the 5th respondent as upa sarpanch is illegal arbitrary against the principles of natural justice and also violative of Articles 14, 19, 21 and 300-A of Constitution of India by setting aside the order dated 23- 07-2022 passed by the 2nd respondent and consequently direct the respondents 2 to 4 not to pass any proceedings / orders until outcome of the judgment of the Honble court in WP No 31219/2022 in the interest of justice and to pass ..."
2. Learned counsel for the petitioner Mr. P. V. Kirshnamachary submits that petitioner is a resident of Nagineniprolu Reddypalem Village. He submits that petitioner is aggrieved by the action of the respondents in reinstating the Sarpanch and Upa-Sarpanch without conducting any enquiry.
3. The writ petition that is filed by the petitioner is in nature of Public Interest Litigation. Hence petitioner shall pursue remedies available to him under law.
4. Accordingly, the writ petition is disposed of giving liberty to the petitioner to pursue his remedies. No order as to costs.
Miscellaneous applications, pending if any, shall stand closed.
