JUDGMENT:
On 26.08.2022, learned counsel for the appellant filed a memo seeking time on the ground that the sole appellant had died and they have to bring his LRs on record, and also have to file the death certificate of the appellant.Therefore, the matter was directed to be listed on 14.09.2022.
Inspite of specific direction, the matter was not listed on 14.09.2022 and it is listed today i.e., 05.12.2022. A perusal of the record discloses that the LRs of the sole appellant are not brought on record till date.
Therefore, the second appeal is dismissed as abated. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
