                       WRIT PETITION No.30924 of 2010

ORDER:

This writ petition is filed for the following relief:

".......to issue any writ, order of direction, more particularly one in nature of Writ Mandamus declaring the action of the respondents in not crediting the Fuel Surcharge Adjustment amount at Rs.0.0291 per unit on the units consumed by the petitioner company having its H.T. Service Connection bearing Nos.MDK- 584, MDK-411, MDK-693, MDK-644, MDK-556, MDK-634, RRN- 848, RRN-1070, RRN-1065 and HDN-907 during the 4th Quarter of the year 2005-2006 as arbitrary, illegal and against to Article 14 of the Constitution of India and as void, and consequently direct the respondents herein to credit the Fuel Surcharge amount totalling to Rs.5,90,660-28 together with interest thereon for the delay in its credit to the petitioner's said H.T. Service connections in time..."

The Learned Counsel for the petitioner and Sri R.Vinod Reddy, Learned Standing Counsel for T.S.TRANSCO appearing for respondents, submitted that the judgment passed by the Hon'ble Supreme Court in Sai Bhaskar Iron Ltd., Vs. A.P.Electricity Regulatory Commission, 1 squarely covers the 1 2016 (9) SCC 134 2 SK, J W.P.No.30924 of 2010 issue raised in the instant case and therefore, this Writ petition is liable to be dismissed.

4. Accordingly, the Writ Petition is dismissed. No order as to costs.

3. Pending miscellaneous applications, if any, shall stand closed.
