SECOND APPEAL No.199 of 2002
JUDGMENT:
It is reported by the learned counsel for the appellant that they have sent a letter to the appellant on 19.11.2022 through registered post, seeking instructions, informing the appellant that matter was listed for hearing and the said letter was returned with an endorsement "No such person". A memo is filed by the learned counsel for the appellant vide U.S.R.No. 110802 of 2022, to that effect.
2. The learned counsel for the appellant reported that they have no instructions in the matter to proceed with the case and requested to pass appropriate orders.
3. On the other hand, Mr P.Mani Sahith, learned counsel representing Sri Abdul Najeeb Khan, learned counsel for the respondent No.1 that he has given no objection to the respondent No.1 and they have no instructions to prosecute the case.
4. Therefore, the second appeal is dismissed for default and for non-prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
