SECOND APPEAL No.217 of 2003
JUDGMENT:
When the matter is taken up for hearing on 01.12.2022, it is reported by Ms.Kalyani, learned counsel respresenting Mr.Kowturu Pavan Kumar, learned counsel for the appellant that, they are unable to contact the appellant for seeking instructions to file substitute service petition.
2. Moreover, the record reveals that notice was not/ordered sent to the respondent though the appeal was filed in the year, 2003.
3. It is further stated by the counsel that they had no instructions. Considering the statement of the learned counsel for the appellant that, they had no instructions to prosecute the matter. Second appeal deserves to be dismissed for default and for non-prosecution.
4. Therefore, the second appeal is dismissed for default and for non-prosecution. No order as to costs.
Pending miscellaneous applications, if any, shall stand closed.
