JUDGMENT:
The appellant/defendant called absent. There is no representation on his behalf.
As per the proceeding sheet dated 11.07.2022 also, there was no representation on behalf of the appellant.
In fact, earlier it was submitted that the advocate on record for the appellant has given no objection Vakalat. Consequently, Registry is directed to print the name of the appellant in the cause title and it was printed. Still there is no response from the appellant.
Having regard to the said fact, as the appellant is not evincing any interest in prosecuting the matter and that the appellant's counsel has already given no objection Vakalat to the appellant, I find no merit to adjourn the matter.

AVRJ CCCA No.308 of 2004 Accordingly, the appeal is dismissed for default for non-prosecution. However, in the circumstances of the case, there shall be no order as to costs.
As a sequel, interlocutory applications, if any pending in this appeal, shall stand closed.
