SECOND APPEAL No.797 OF 2016
JUDGMENT:
1. The present appeal has been directed against judgment and decree dated 02.06.2016 passed in A.S.No.123 of 2009 by the Principal District Judge, Ranga Reddy District at L.B. Nagar, wherein and whereby the judgment and decree dt.27.02.2009 passed in O.S.No.766 of 2000 by the IV Additional Senior Civil Judge, was reversed. The said suit was filed by the plaintiff for specific performance of contract.
2. The present appeal is at the instance of plaintiff. Direction given not complied with by the learned Counsel for appellant in spite of availing sufficient time for service of notice on the respondent. Though the matter is listed under the caption "for dismissal" there is no representation from the appellant.
3. Accordingly, this Second Appeal is dismissed for non-prosecution. No order as to costs.
4. As a sequel, pending miscellaneous applications, if any, shall stand closed.
