Judgment:

1.    This Appeal is filed against Order dated 14.09.2012 passed by

the learned V Senior Civil Judge, City Civil Court at Hyderabad,

whereby O.S.No.2 of 2009 filed by the respondent/plaintiff for

recovery of money was decreed for a sum of Rs.9,52,480/- together

with costs and interest @ 12% p.a., on the principal amount of

Rs.3,70,000/- from the date of suit till the date of decree.


2.    On 27.09.2021, learned counsel for the appellant/defendant

undertook to pay the decretal amount including the advocate fees,

which comes to Rs.7,35,956/- by way of a demand draft and that the

property under attachment in E.P.No.143 of 2013 on the file of the

learned V Senior Civil Judge, City Civil Court at Hyderabad, be

released, for which learned counsel for the respondent/plaintiff had

reported no objection.


3.    Today, learned counsel for the appellant/defendant has filed a

Memo dated 28.09.2021 duly enclosing a Bankers Cheque bearing

No.694319 dated 27.09.2021, drawn from State Bank of India,

Puppalaguda, Manikonda, for an amount of Rs.7,35,956/- in favour of

Pabba Nanda Kishore i.e., the respondent herein, towards full and

final settlement of the decretal amount in O.S.No.2 of 2009.

4.    The Memo along with the Bankers Cheque is taken on record.

Learned counsel for the respondent/plaintiff is permitted to approach

the Registrar (Judicial) to receive the Bankers Cheque.             The

Registrar(Judicial) shall hand over the Bankers Cheque referred to

above to learned counsel for the respondent/plaintiff under proper

acknowledgment.


5.    On the respondent/plaintiff producing the proof of receipt of

the Bankers Cheque, the property under attachment i.e., Plot No.24/C

admeasuring 1950.64 square yards situated in Survey Nos.334, 335,

336 and 337 of Bachipally Village, Qutbullapur Mandal, Ranga Reddy

District, shall be released in favour of the appellant/defendant.


6.    CCCA is, accordingly, disposed of.


7.    As a sequel, Miscellaneous Petitions, pending if any, stand

disposed of.
