ORDER:
This writ petition has been filed questioning the inaction of the respondents, particularly the 3rd respondent, Regional Manager, in taking action on the petition dated 22.07.2021.
The petitioner was charged and tried for the offence under Section 304(A) IPC in C.C. No.171 of 2015 on the file of the IV Special Magistrate, Hasthinapuram, Ranga Reddy District. The case ended in acquittal vide order dated 09.02.2016. Prior to acquittal of the petitioner, he was subjected to departmental proceedings and order dated 19.11.2015 was passed deferring annual increment for a period of two years with cumulative effect on future increment. Challenging the same, the petitioner filed appeal before the Divisional Manager, JBS, Secunderabad and the appeal came to be dismissed by order dated 28.07.2018. Thereafter, the petitioner filed review petition before the Regional Officer, Secunderabad and review was dismissed by order dated 31.10.2018. Thereafter, the petitioner submitted representation dated 22.07.2021 seeking recall of the order dated 31.10.2018 dismissing his review petition by taking into consideration the judgment of acquittal passed in C.C. No.171 of 2015 on the file of the IV Special Magistrate, Hasthinapuram, Ranga Reddy District.
The grievance of the petitioner is that the respondent No.3 has not passed any orders on his representation/petition dated 22.07.2021.
In the circumstances, it is deemed appropriate to direct the respondents to pass orders on the representation/petition dated 22.07.2021 filed for recalling order dated 31.10.2018 duly taking into consideration the acquittal of the petitioner in C.C. No.171 of 2015 on the file of the IV Special Magistrate, Hasthinapuram, Ranga Reddy District. The orders in the said representation/petition shall be passed within a period of six weeks from the date of receipt of a copy of this order.
In the result, this Writ Petition is disposed of accordingly. Miscellaneous applications if any pending shall stand closed. There shall be no order as to costs.
