WRIT PETITION No. 21713 of 2021
ORDER:
In this writ petition, the petitioner seeks to set aside the orders passed by respondent No. 2 i.e., the Special Tribunal, Nizamabad District, dated 24.06.2021 in Special Tribunal Case No. D2/300/2021 (old case No. A3/612/2019).
Even though several grounds have been raised by the petitioner, seeking to set aside the impugned order, having regard to the fact that the petitioner has already filed two civil suits being O.S. No. 105 of 2019 and O.S. No. 163 of 2019 for declaration and permanent injunction. on the file of Principal Junior Civil Judge at Bodhan, this Court is not inclined to pass any relief, as sought for in the present writ petition. Unless and until the petitioner succeeds in the said suits filed by him, no relief can be granted in his favour. The mutation entries do not confer any title on the person in whose name entries are made. Ultimately, if the petitioner succeeds in the suit filed by him, the revenue authorities are bound to implement the Judgment and Decree of the Court.
The writ petition fails and the same is accordingly dismissed. However, if the petitioner is so advised, he 2 can file an appropriate application before the trial Court in the pending suits.
Pending miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
